CASSATION PROCEEDINGS IN A CIVIL PROCESS

Monograph

In the monograph Kovtkova D. I. «Cassation proceedings in the civil process» discussed the current problematic issues of the appeal proceedings in the civil process.

The work has been fully considered and are persuasive arguments that the judge of the court of cassation under consideration filed a cassation complaint, representation has the right to unilaterally verify and assess only the technical legal requirements for a cassation complaint, representation, because, in making at the present time ruling on refusal to transfer the cassation complaint, representation with the case for consideration in judicial session by the court of cassation instance, the judge actually alone realizes the authority of the court of cassation instance stipulated in clause 1 of part 1 of article 390 of the Civil procedural code of the Russian Federation.

In addition, the issue had never been raised in the scientific literature associated with the filing of the appeal of successors of persons not involved in the case, on the rights and obligations which the court took judicial act; defines the procedure and terms of appeal against such persons in the cassation and supervising instances have entered Into legal force judicial acts that violated their rights and legitimate interests.

The practical significance of the work lies in the fact that its findings can applied in the preparation of amendments and additions to the norms of the civil procedural law, in the preparation of the clarifications of the Plenum of the Supreme Court of the Russian Federation, and also in lecture «Civil litigation», «Arbitration proceedings» and prepare training manuals on these training courses.
