The book gives an article-by-article commentary to the Federal law № 218-FZ of July 13, 2015 «On state registration of real estate» as amended, including by the Federal law № 361-FZ of July 3, 2016. It also gives a detailed review of the content and rules of conducting the Unified state register of real estate (EGRN), the procedure for state cadastral registration and state registration of rights, the procedure for correcting errors the EGRN contains, the order of reporting the information the EGRN contains, features of the legal status of the state registrar of rights, the responsibility of the registration body and the state registrar of rights.
A comparative analysis with the norms of the «predecessors» – the Federal law № 122-FZ of July 21, 1997 «On state registration of rights to own real estate and transactions with it» and № 221-FZ of July 24, 2007 «On state real estate cadastre» – has been done. An overview of statutory and regulatory acts issued in order to implement the provisions of the commented law is also presented in the book. The legal positions of the highest judicial bodies, the views of the Ministry of economic development and Rosreestr on the application of the provisions of the Act are taken into account.
The book is intended primarily for legal professionals, persons for whose benefit state cadastral registration and state registration of rights are implemented, for the officials of the registry of rights authority and for state registrars. The book will also be useful for anyone interested in the issues of legal regulation of state registration of real estate in Russia.
