U.S. Identity Theft and Assumption Deterrence Act of 1998
ОглавлениеThe Identity Theft and Assumption Deterrence Act was enacted in 1998, and formally established identity theft as a criminal act under U.S. federal law. Under the act, identity theft is “knowingly transfer[ring] or us[ing], without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law.” Prior to the act, identity theft was not regulated or investigated as a crime, which made it difficult to prosecute the growing number of identity theft claims stemming from the rise of the internet.
