Responsabilidad del Estado por actos terroristas: estudio de derecho comparado entre Colombia y España

Resumen

Este libro presenta un estudio de derecho comparado entre Colombia y España. Se centra en la institución jurídica de responsabilidad del Estado por actos terroristas. Surge de una investigación en la que confluyen dos grandes materias: el terrorismo y el derecho administrativo. Así mismo, pretende crear conocimiento científico al efectuar una microcomparación de la institución jurídica mencionada previamente a partir del análisis y la confrontación de los componentes constitucional, legal y jurisprudencial, para obtener las principales semejanzas y diferencias entre ambos sistemas, además de presentar una postura crítico-constructiva del ordenamiento jurídico colombiano para perfeccionar su modelo. La obra se divide en seis partes: la primera contiene una introducción, los aspectos metodológicos y la finalidad de la investigación; la segunda estudia la noción de terrorismo y sus vertientes; la tercera y la cuarta se centran en la construcción de los modelos jurídicos en Colombia y España, con el análisis de sus instituciones y componentes al resaltar sus fortalezas, incoherencias, vacíos y alcance; la quinta presenta el análisis de derecho comparado propiamente dicho y los resultados de la investigación, para finalizar con la sexta parte de conclusiones generales.

State Responsibility for Terrorist Acts: A Comparative Law Study of Colombia and Spain

Abstract

This book presents a comparative law study of Colombia and Spain. It focuses on the legal institution of state responsibility for terrorist acts. It arises from an investigation in which two major matters converge: terrorism and administrative law. Similarly, it aims to create scientific knowledge through a micro-comparison of the previously mentioned legal institution based on the analysis and comparison of constitutional, legal, and jurisprudential components, seeking to identify the main similarities and differences between both systems, in addition to presenting a critical-constructive view of the Colombian legal system in order to perfect its model. The work is divided into six parts. The first part includes an introduction and describes the methodological aspects and the purpose of the research. The second one examines the notion of terrorism and its aspects, while the third and fourth parts focus on the construction of legal models in Colombia and Spain, with an analysis of their institutions and components, highlighting their strengths, inconsistencies, gaps, and scope. The fifth part presents the comparative law analysis itself and the results of the research, ending with a sixth part dedicated to general conclusions.
