cc) The Commission’s measure as last resort

However, in both the above scenarios – when Member States opt for an action plan or to reconfigure a zone – the involved Member States must decide unanimously or the Commission, as a last resort, must consult ACER (and the relevant stakeholders in case of a reconfiguration) and then make a decision whether to enhance or maintain the bidding zone’s configuration.

This procedure clearly shows that the elimination of bottlenecks in the networks is, on the one hand, a joint task in which several actors are involved, namely transmission operators, Member States, national regulators, ENTSO, ACER and the Commission. Interestingly, even though Member States are key figures in this list as they have expansive competence to eliminate energy bottlenecks, the procedure works best when all actors are involved in a cooperative manner. The failsafe, as previously mentioned, is that if cooperation does break down, the Commission can exercise its authority as a last resort option to overcome any impasses and decide whether to amend or maintain the bidding zone configuration in and between those Member States.
