5. COMPULSORY INSURANCE UNDER NATIONAL LAW

Alongside the duties imposed by the European Union to take out liability insurance there is a great variety of compulsory insurances under national law which differs from Member State to Member State. They may be laid down at the national level or within the regions, sometimes even at the local level or by the bylaws of entities established under public law such as certain trade associations. Their number is fairly small in some countries such as Germany and much higher in other Member States; it is said to amount to almost 80 in Italy, 120 in France and around 400 in Spain28. The detailed rules concerning the scope and extent of those compulsory liability insurances as well as admitted exceptions differ likewise and are often not even clearly regulated at the national level. A telling example is the breast implants case that was decided by the Court of Justice of the European Union.
