Judgment T-622 of 2016 declares the Atrato river, its basin and tributaries as an entity subject to rights to the protection, conservation, maintenance and restoration by the State and ethnic communities. With this decision, the legal concept of the environment could be affected, to verify if this is possible, this chapter studies the bases of the decision, in this framework, a weak argument of the proposed legal category was verified, due to an improper application of the precautionary principle and the absence of an analysis on “legal personhood”. Likewise, the proposed paradigm and the sufficiency of this judicial decision are analyzed as a legal mechanism that achieves a balance between the ordered measures adopted, the time and resources invested that ultimately lead to true protection, maintenance, restoration and conservation of natural resources.
