Finally, with regard to the case-law of the European Court of Justice (which, as per article 19 TEU, includes the Court of Justice and the General Court) we can see that statistically, almost 100 energy cases have been brought before the Court of Justice and the General Court. If we exclude some 30 cases removed from the register, the remaining cases may be divided into eight categories:

1. interim measures16,

2. liberalisation of the gas and electricity markets at production and distribution level17,

3. ACER (concerning the application and interpretation of the Regulation 713/2009 establishing the ACER that now has been repealed by Regulation (EU) 2019/942 of the European Parliament and of the Council of 5 June 2019)18,

4. cartels and abuse of dominant positions (Articles 101 and 102 TFEU)19,

5. control of concentrations (Regulation 4064/89 of the Council of 21.12.1989, Regulation 139/2004 of the Council of 20.1.2004)20,

6. state aid (articles 107, 108 TFEU)21,

7. energy and taxation22, and

8. energy and the environment (i. Energy efficiency23, ii. promotion of the use of energy from renewable sources24, iii. Greenhouse gas emission allowance trading25).
