CONCLUSIONS
ОглавлениеThis initiative of IIDM is to be applauded and I am grateful for the invitation to participate and to make this comparative search on salvage.
Apologises for any misunderstandings and errors in my interpretation of Spanish law, possibly due to a not very good knowledge of Spanish language.
Law 3. 4/2014 is an example of modern legislation, structured and oriented towards uniformity.
In addition to making a comparative analysis between a subject in Spanish Law 14/2014 and the relating subject in their legal system, the contributors to this Maritime Law Book are invited to suggest ways to achieve uniformity and modernization of maritime law in Ibero America in relation with the chosen subject.
The adoption of maritime rules through international conventions is certainly the best method to achieve uniformity.
Two requisites are essentially needed: that an international instrument containing modern rules is adopted and that such an instrument is ratified and implemented in national laws by a large number of States.
There are some nine Ibero American States party to the 1910 Salvage Convention and six which are party to the 1989 Salvage Convention.
The State parties to the 1989 Salvage Convention total sixtynine and the suggestion is that it be acceded by a higher number of Ibero American States, possibly by all the twelve Ibero American States members of CMI and also by all the twentyone States members of IIDM.
