RESUMEN: el derecho internacional de los derechos humanos ha sido cada vez más enfático en otorgar a las empresas obligaciones en materia de garantía de derechos humanos y del medio ambiente, y muchas veces en conciliarlas con los intereses de la actividad económica que desarrollan no resulta una tarea pacífica. Ello se evidencia con el surgimiento de conflictos en la materia a lo largo del mundo. Por esta razón, los derechos humanos, las empresas y el medio ambiente vienen siendo un asunto controversial en la intervención judicial en la esfera global, regional y estatal. Este artículo pretende ofrecer algunos aportes respecto de los diversos mecanismos para la defensa de los derechos humanos y del medio ambiente frente a la actuación de las empresas, y cómo estos se convierten cada vez más en verdaderos criterios de interpretación que ofrecen a los tribunales del mundo, especialmente a la Corte Constitucional colombiana, herramientas para la efectiva protección de los derechos humanos y del medio ambiente.

ABSTRACT: International human rights law has been increasingly emphatic in setting forth duties for companies related to human rights protection and the environment. Combining them with the interests of the economic activity they carry out is often a daunting task. This is highlighted by the emergence of conflicts on the matter all around the world. For this reason, human rights, business and the environment have been a controversial issue in terms of judicial intervention at the global, regional, and national level. This article aims to offer some contributions regarding the various mechanisms for the defense of human rights and the environment against the activity of companies and how these increasingly become interpretation criteria offering courts around the world in particular the Colombian Constitutional Court–tools for the effective protection of human rights and the environment.
