RESUMEN: el sector minero-energético, a través de la aplicación de estándares, contribuye a la labor del Estado en la promoción y respeto de los derechos humanos. El objetivo de este artículo es analizar cómo los estándares del sector se relacionan con los derechos humanos. Se concluye que dicha relación, desde el punto de vista teórico, es clara, pero desde el punto de vista práctico vislumbra ambigüedades y vacíos. Por ello la interacción entre empresas y Estado requiere mejoras y esfuerzos para lograr materializar los propósitos y metas del Plan Nacional de Acción de Derechos Humanos y Empresas 2015-2018 y de la Política de Derechos Humanos del Sector Minero Energético, documentos que han surgido como parte del desarrollo de la normatividad nacional e internacional sobre derechos humanos y empresas.

ABSTRACT: The energy mining sector, through the application of standards, contributes to the work of the State in the promotion and respect of human rights. The objective of this article is to analyze how industry standards relate to human rights. It is concluded that this relationship, from the theoretical point of view, is clear, but from the practical point of view glimpses ambiguities and gaps. Therefore, the interaction between companies and the State requires improvements and efforts to achieve the goals and objectives of the National Plan of Action for Human Rights and Business 2015-2018 and the Human Rights Policy for the Mining and Energy Sector, documents that have emerged as part of the development of national and international human rights law and business.
